1) Eligibility: The Help Batman Keep the Joker In Jail Sweepstakes! (the "Sweepstakes or Promotion") is open only to legal residents of the United States (excluding Puerto Rico, U.S. Virgin Islands and Guam) who are 16 years of age or older at the time of entry. Employees of Amscan Holdings, Incorporated (the “Sponsor”), COHEN-FRIEDBERG ASSOCIATES, LLC (the “Judges”), Collectively (the “Promotion Entities”), and all of their respective parents, subsidiaries, dealers, franchisees, affiliates, directors, officers, shareholders, governors, employees, and agents, as well as their respective spouses, children, siblings, and all others residing in the same household as such employees, are not eligible to participate. The Promotion is subject to all federal, state, and local laws and regulations. Void where prohibited by law. The Help Batman Keep the Joker In Jail Sweepstakes entry forms may be found at Point of Sale displays at all Sponsor retail stores between 9/1/08 and 11/8/2008 (while supplies last). You may also enter by mailing a postcard to be received by 11/8/2008 to, “Help Batman Keep the Joker In Jail Sweepstakes” PO Box 2001, Framingham, MA 01703-2001.
2) Agreement to Official Rules: By participating in this Sweepstakes, each entrant agrees to abide by these Official Rules and the decisions of the Judges, which are final and legally binding as they pertain to this Sweepstakes. All entries become the property of the Sponsor.
3) Timing: Promotion starts at 12:01 am Eastern Time (ET) on Monday, September 1, 2008 and ends at 11:59 pm (ET) on Saturday, November 8, 2008, (the "Promotion Period"). All entries must be made in-store or by mail no later than 11/8/2008. LIMIT: One prize per person or household.
4) Drawings & Winner Selection: A random Sweepstakes drawing will be conducted on or about Tuesday, 11/21/2008 from all valid entries received. The Sweepstakes drawings will be under the control of the Judges whose decisions shall be final and legally binding as they pertain to this Sweepstakes. Winner will be notified via phone, email, mail or express mail whichever is appropriate. Failure to reply to this prize winning notification within 10 days of notification to claim prize, will disqualify the entry and an alternative winner will be selected. 5) PRIZES: Only the number of prizes described below will be awarded in this promotion.
(2) GRAND PRIZES: Family vacation for four (4) to Warner Bros. studio in California. Prize includes the following:
- Roundtrip (coach class) airfare.
- (4) Four nights Sheraton Universal Studios (traditional room) Hotel accommodations (includes tax and service fees).
- (5) Five days rental (mid size) car
- VIP tour for 4 of Warner Bros. back lot and studio (minimum age requirement: 8 years and older).
Approximate retail value $ 4,700.
(5) FIRST PRIZES: Large Statuettes of Batman. Approximate Retail Value $250.
(50) SECOND PRIZES: Batman The Dark Knight DVD. Approximate Retail Value $24 each.
PLEASE NOTE: Prizes are not transferable by winner. No substitution of prize or cash equivalent is permitted except by Sponsor. Winner will look to the manufacturer of each prize element for all warranties and guarantees (if any), and not to the Sponsor.
Grand Prize Notes: Prize value may vary based on airfare fluctuations and hotel availability. All travel reservations must be made 30 days in advance. Travel arrangements must be booked through Sponsors’ agent and on a carrier of Sponsors’ choice. Travel arrangements cannot be changed in any way once booked and confirmed. Travel is subject to availability and certain travel restrictions and blackout dates may apply. Prize is valid for one calendar year from issue date. No extension will be given after the trip has expired and prize will be forfeited and Sponsor will have no further obligation to winner. Sponsor is not responsible for lost or stolen prize certificates/redemption letters and the prize is not redeemable without the original prize certificates/ redemption letters. Winner is responsible for any and all local, state and/or federal taxes, as well as any other costs and expenses not specified herein as being awarded, including, without limitation, food, tours, gift shop purchases, incidentals, telephone calls or other personal expenses or hotel charges incurred. If any winner or guest is a minor, they must be accompanied by the minor's parent or legal guardian. Winner and guests must have a valid identification documents as required by airlines to travel. Winner and guests must travel depart/return on the same flights on the same day. Winner and guests are responsible for all expenses not listed above Air tickets are non-refundable/non-transferable and are not valid for upgrades and/or frequent flyer miles.
Total Approximate Retail Value of all prizes $11,850. Each winner shall be solely responsible for all federal, state and local taxes, and the reporting consequences thereof, and for any fees or costs associated with the applicable prize. The Grand Prize winners will be issued a 1099 Tax Reporting form at the end of the year.
6) ALL POTENTIAL SWEEPSTAKES WINNERS ARE SUBJECT TO VERIFICATION BY THE JUDGES. AN ENTRANT IS NOT A WINNER OF ANY PRIZE, UNLESS AND UNTIL ENTRANT'S ELIGIBILITY HAS BEEN VERIFIED.
7) Potential Sweepstakes Winners: ALL Potential winners must comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements. Each potential winner of a major prize (prize valued over $600 must complete, sign and return an Affidavit of Eligibility and Liability/Publicity Release within ten (10) days, consenting to the publication of his/her name in any media for any promotional purpose relating to the announcement of winners of the Promotion, without further compensation. If a potential winner cannot be contacted, or if he/she fails to sign and return the Affidavit of Eligibility and Liability/Publicity Release within the required time period or if notices are returned as undeliverable, an alternate winner will be selected from the Second Chance drawing pool. If any Grand or First prize is not awarded or claimed during the Promotion Period, a random drawing to award such prize will take place. Eligible winners of all other prizes will receive their prizes within 4-6 weeks after the conclusion of the Promotion Period.
8) Publicity: Except where prohibited, participation in the Promotion constitutes winner's consent to Sponsors or agents the use of winner's name, likeness, voice, opinions, biographical information, hometown and state for promotional purposes relating to the announcement of winners of the Promotion in any media without further payment or consideration.
9) General Conditions: Sponsor and/or Judges may cancel or modify the Sweepstakes or these Official Rules if fraud, technical failures or any other factor beyond their control impairs the integrity of the Promotion, as determined by Sponsor and the Judges in their sole discretion. In such event, Sponsor may award the prizes at random from among the eligible entries received up to the time of the impairment. Sponsor and Judges may, in their sole discretion, disqualify any individual they find to be tampering with the entry process or the operation of the Promotion or to be acting in violation of these Official Rules, or in an unsportsmanlike or disruptive manner. Sponsor and/or Judges failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
10) Release: By entering entrant agrees to hold harmless and indemnify the Sponsor, Judges, Promotion Entities, Warner Bros. Consumer Products Inc. (“WBCP”) and their respective parents, subsidiaries, affiliates, dealers, directors, stock holders, officers, governors, employees and agents against any and all liability, damages or causes of action (however named or described), with respect to or arising out of either (i) entrant's participation; or (ii) the receipt or use of the prizes awarded in the promotion.
11) Limitations of Liability: Sponsor, Judges, WBCP, and the Promotion Entities are not responsible for, and entrant hereby releases Sponsor, Judges, and the Promotion Entities from any claims arising from: (i) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (ii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iii) unauthorized human intervention in any part of the entry process or the Promotion; (iv) electronic or human error which may occur in the administration of the Promotion or the processing of entries; or (v) any injury or damage to persons or property, including but not limited to entrant's computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Promotion.
12) Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the state of New Jersey; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys' fees; and (3) unless otherwise prohibited, under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Promotion shall be governed by, and construed in accordance with, the laws of the state of New Jersey, without giving effect to any choice of law or conflict of law rules (whether of the state of New Jersey or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state of New Jersey.
13) Participants Personal Information: By entering into this promotion, each entrant agrees to Sponsor and Promotion Entities and other related parties participating in this Sweepstakes use of personal information collected in this Sweepstakes.
14) Winners List: For a list of prize winners and a copy of these Official Rules send a self-addressed, stamped envelope to “Help Batman Keep the Joker In Jail Sweepstakes (rules or winner’s list request), PO Box 2001, Framingham, MA 01703-2001. Vermont residents may omit return postage. Requests must be received by 11/21/2008.
